The Mental Capacity Act 2005

Every day we make decisions about lots of things in our lives, this ability is called mental capacity. Sometimes people can have difficulty making decisions all or some of the time due to mental health problems, a learning disability or dementia. The Mental Capacity Act 2005 (MCA) comes into force in April through to October 2007. This Act affects anyone who is unable to make a decision at points in their life such as moving to a care home or decisions related to serious medical treatment. It protects their rights to make decisions with the main source of support to do this being Independent Mental Capacity Advocates.

From October 2007 the Act will make changes to Enduring Powers of Attorney which will include allowing people to make advanced decisions to refuse treatment and to appoint someone to look after your well being and financial affairs.
